Terms of Use

These Terms are an agreement between you and Sandbox Pitch & Putt LLC ("Sandbox", "we", "us") about the Sandbox app for iPhone and Apple Watch and our websites (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility and your account

  • You must be at least 13. If you're under 18, a parent or guardian must agree to these Terms for you.
  • The Service is meant for use in the United States. You can't use it if we've removed you before.
  • Give accurate information, keep your password private, and have only one account, your own. You're responsible for what happens on your account. We may change or reclaim an @handle that misleads or infringes someone's rights.

2. Rules of conduct

You agree not to:

  • harass, threaten or intimidate anyone, or post hateful, sexual, violent or otherwise objectionable content, or anything that endangers a minor;
  • share someone's private information, spam other golfers, or impersonate anyone;
  • enter false scores or results, or manipulate ratings or matchmaking, for example by sandbagging, losing on purpose, colluding or playing fake matches;
  • use the Service for betting or gambling;
  • break the law, a course's rules or anyone's rights;
  • copy, modify, reverse engineer, decompile or disassemble the Service, or try to discover its source code, algorithms or matching or rating methods, except where the law expressly allows it;
  • access or collect data from the Service with bots, scrapers or other automated means, or interfere with, overload or get around the security of the Service or any block;
  • use the Service, or any data from it, to build, train or benchmark a competing product or service.

3. Zero tolerance for objectionable content and abusive users

We have zero tolerance for objectionable content and abusive users. We screen text for objectionable content and may block it from being posted. You can report content or a player in the app or at support@sbx.golf, and you can block any player. We review reports within 24 hours, remove content that breaks these Terms, and remove users who post it or abuse others.

4. Your content

Your content (your profile, photo, messages, scores and anything else you post) stays yours. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and adapt it to run and improve the Service. The license ends when your content is deleted, except for content we keep in anonymized form, such as match results, and copies others already have. You're responsible for your content and must have the right to post it. We may remove any content, and we don't have to review it before it's posted.

5. Ratings, points and our systems

Sandbox's matchmaking, the Sandbox Rating (SBX), and the methods, data and software behind them are our proprietary and confidential information, and we may change them at any time. SBX isn't an official handicap. Ratings, rankings, results and Sandbox Points have no monetary value, give you no rights and can't be sold or transferred, and we may recalculate, adjust, hide or reset them, for example to correct errors or protect fair play.

6. Partner courses

  • Sandbox doesn't own or operate any golf course. The course sets its price, which you pay the course, and its rules, which you must follow. It may refuse or end play.
  • We can't promise a game, a tee time, particular players or a format, and we or the course may change or cancel a tee time.
  • Private matches you arrange at other courses are between you and that course.

7. Golf and other golfers

Golf carries real risks, including injury from balls and clubs, falls, heat and lightning. You're responsible for your own safety and conduct. To the fullest extent the law allows, you accept these risks, and Sandbox isn't responsible for injuries or losses at a course or during play. We don't supervise play or screen players. Golfers you meet through Sandbox aren't our employees or agents, we aren't responsible for what they do, and disputes between golfers are theirs to resolve.

8. Our Service

  • Subject to these Terms, we give you a personal, non-transferable, revocable license to use the Service for your own non-commercial use.
  • The Service, its software, design and content (other than your content), and the names and marks Sandbox, Sandbox Pitch & Putt, SBX and Sandbox Rating, with our logos, belong to us or our licensors. You may not use them without our written permission.
  • We may change, suspend or stop any part of the Service.
  • If you send us ideas or suggestions, you give us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose, without owing you anything.

9. Ending your account

You can delete your account in the app (You → Settings → Delete account). We may suspend or end your access at any time if you break these Terms, if the law requires it, or to protect other golfers or Sandbox. Sections 2, 4 (for content kept in anonymized form), 5, 7, 8 and 10 through 14 still apply after your account ends.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the Service, ratings, results, course information or matchmaking will be accurate, available, uninterrupted, error-free or secure.

11. Limitation of liability

To the fullest extent the law allows, Sandbox and its owners, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Service or these Terms, and our total liability for any claim relating to the Service is limited to US $100. Some places don't allow some of these limits, so they may not all apply to you.

12. Indemnity

If you break these Terms or the law, or your content or conduct causes a claim against Sandbox, you agree to cover Sandbox's reasonable losses and costs from that claim, to the extent the law allows.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and Sandbox consent to those courts' jurisdiction.

14. Changes and general terms

  • We may update these Terms. We'll change the date above and notify you before a significant change takes effect. If you keep using the Service after that, you accept the new Terms.
  • If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to.
  • You can't transfer these Terms. We may transfer them if Sandbox is sold or merged.
  • These Terms and the Privacy Policy are the whole agreement between you and Sandbox about the Service.
